Welcome to Cardify ("Cardify", "we", "us"). By accessing or using our website, mobile apps, APIs, and related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Cardify. Children under 16 in the EU/EEA require parental consent. By creating an account you represent that you meet these requirements.
2. Your account
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or our Content & AI Policy.
3. Your content and AI generations
- You retain ownership of the photos you upload ("Source Content").
- You grant Cardify a worldwide, non-exclusive, royalty-free license to host, process, display, and reproduce Source Content solely to operate, improve, and secure the Service.
- Subject to your compliance with these Terms, you own the cards generated from your Source Content ("Generated Content") for personal and lawful commercial use, except for shared template elements, frames, and proprietary visual assets which remain Cardify's property.
- You will not upload Source Content depicting other people without their consent, or content that infringes third-party rights.
4. Acceptable use & usage limitations
You will not use the Service to create or distribute content that is unlawful, sexual content involving minors, non-consensual intimate imagery, hate speech, harassment, deepfakes intended to deceive, or any content prohibited by our Content & AI Policy.
You agree not to upload Source Content that contains or depicts:
- Third-party trademarks, brand logos, or service marks without authorization.
- Professional sports team names, league names, or league logos.
- Athlete, celebrity, or public figure likenesses without their consent.
- Copyrighted characters, artwork, or other protected works you do not own or have permission to use.
- Any content intended to impersonate, deceive, or mislead others about the origin or affiliation of the generated card.
We may scan uploaded content for protected terms and refuse processing if prohibited content is detected. We may remove content and terminate accounts for violations.
5. Free beta
Cardify is currently offered free of charge while in beta. We may introduce paid features in the future; if and when we do, we will update these Terms before charging for them.
6. Intellectual property
The Cardify name, logo, design system, frames, holographic effects, rarity system, and software are owned by Cardify and protected by intellectual property laws. Nothing in these Terms transfers ownership of our IP to you.
6a. Entertainment, parody & fan-art nature
Cardify is an independent entertainment, parody, and novelty tool. All cards, scans, ratings, valuations, rarities, stats, lore, and related outputs are algorithmic, creative expressions produced for amusement only. Nothing generated by the Service constitutes an official product, endorsement, affiliation, appraisal, authentication, or statement of fact. The Service transforms user-provided photos into stylized, fictional trading-card parodies and should be understood strictly as entertainment and fan-art commentary.
6b. Third-party trademarks & fan-art use
Cardify is an independent fan-art, parody, and novelty tool. All third-party trademarks, service marks, trade names, logos, team names, league names, character names, athlete likenesses, and brand identities referenced or stylistically suggested by any template, style preset, or generated card remain the exclusive property of their respective owners. Cardify is not affiliated with, endorsed by, sponsored by, or licensed by the NFL, MLB, NBA, WNBA, MLS, FIFA, UEFA, Formula 1, FIA, UFC, The Pokémon Company, Nintendo, Game Freak, Konami, Wizards of the Coast, Hasbro, Marvel, DC, Disney, any K-Pop label or artist, any record label, any film studio, or any other rights holder. You agree not to use the Service to (a) imply such affiliation, sponsorship, or endorsement, (b) sell unauthorized merchandise, or (c) reproduce protected works in a manner that exceeds fair use, parody, or other applicable exceptions in your jurisdiction.
6c. Right of publicity & consent
You may only upload photographs of yourself, of people who have given you their explicit consent, or of subjects you otherwise have the legal right to use. You will not generate or distribute deceptive deepfakes, sexual or harassing depictions of identifiable people, or any content that violates a third party's right of publicity, privacy, or moral rights.
6d. Card values, grades & ratings
Any market value estimates, Cardify-style grades, condition assessments, set or year identifications, "power levels", or rarity tiers produced by the Service are algorithmic, non-binding estimates for entertainment only. They are not official BGS, CGC, SGC, TAG, or HGA grades and do not constitute appraisals, authentications, or guarantees of value. Always consult a licensed professional grader or appraiser before relying on any value for a real-world transaction.
7. Third-party services
Cardify uses third-party providers for hosting, authentication, and AI processing. Your use of those features is subject to those providers' terms.
7a. DMCA & rights-holder takedown
We respect intellectual property. Notices of claimed copyright or trademark infringement may be submitted through our web form and must include the elements required by 17 U.S.C. § 512(c)(3) (or the equivalent in your jurisdiction): your contact information, identification of the work, the URL or sufficient detail to locate the material, a good-faith statement, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your signature. We will respond promptly and may remove allegedly infringing material, terminate repeat infringers, and notify the affected user.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted operation or specific generation outputs.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARDIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS YOU PAID TO CARDIFY IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
10. Indemnity
You will indemnify and hold harmless Cardify and its affiliates from any claims, damages, and expenses (including attorneys' fees) arising from your Source Content, your Generated Content, or your breach of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms or for risk to the Service or other users. Sections that by their nature survive termination will survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Disputes will be resolved by binding individual arbitration; class actions are waived to the extent permitted by law. EU/EEA consumers retain mandatory protections of their local law.
13. Changes
We may update these Terms. We will notify you of material changes; continued use after the effective date constitutes acceptance.
